The race has proven historically stable throughout the year, according to polling analysts, and big campaign moments including the national conventions and Biden’s selection of Kamala Harris as a running mate do not appear to have moved the needle.For weeks, the Trump campaign has been touting the debate as the moment that would at last alter the race, regaling donors with a fantasy of a quick-witted Trump running circles around a somnolent Biden.Trump went so far at the weekend as to demand a “drug test” before the debate of Biden, whom Trump has baselessly accused of taking “performance enhancing drugs”.Biden laughed off the suggestion, but his campaign issued a lacerating response.“Vice-President Biden intends to deliver his debate answers in words,” a Biden spokeswoman told Politico. “If the president thinks his best case is made in urine, he can have at it.”Biden and Trump are scheduled to participate in three debates total. Why a Biden blowout is still the most likely result Five weeks out from the 2020 presidential election, significant media attention is being given to the small possibility that President Donald Trump could again pull off a narrow Electoral College victory while losing the popular vote, or that even an Electoral College tie could push the election to the House. Those scenarios, though, are mainly making headlines because they're interesting fodder for the pundit class. All the data point to a big blowout victory for Democratic nominee Joe Biden.The major recent polls (Economist/YouGov: Biden +7, CNBC: Biden +9, Quinnipiac: Biden +10, NYT: Biden +8) show Biden with a truly commanding lead nationally. Equally important is how Biden leads. The 2016 election was always a much closer and more dynamic race, Trump was facing a much more unpopular opponent, and a much larger number of voters were undecided. None of those are the case this time.This year we have experienced a global pandemic which has so far killed over 200,000 Americans, a massive economic disruption, multiple Trump administration scandals, and the death of Supreme Court Justice Ruth Bader Ginsburg. Yet Biden's large lead over Trump is basically identical to what it was at the end of last year. There is still the possibility that some new development — even bigger than those listed above — could shift the dynamics of the race, but that seems very unlikely.Biden also polls much better than Hillary Clinton ever did in the late stages of the 2016 election cycle — largely because there are significantly fewer undecided and third-party voters. In the RealClearPolitics polling average of the four-way race, Clinton's share of the vote never went over 46.2 percent while, by comparison, Biden has been bouncing right around 50 percent for the past few months with 7 percent third-party/undecided. To realistically win, Trump would need to pick up almost all the undecided voters and even flip some Biden voters.In 2016, both candidates were unpopular. The final YouGov poll found Clinton with a favorable rating of 43 percent and 56 percent unfavorable, compared to Trump's rating of 39 percent favorable and 60 percent unfavorable. This gave the outsider Trump a chance to win over voters who disliked both candidates. By comparison, right now Biden's favorability numbers are 45 percent to 47 percent compared to Trump at 42 percent favorable and 53 unfavorable. In addition, 52 percent of voters disapprove of how Trump has handled his job as president, while 57 percent of voters are upset or dissatisfied with Trump. Trump effectively needs to win over voters who dislike him, disapprove of his job performance, and are simply ambivalent about Biden.To be sure, in 2016, the very limited polling in certain critical swing states was off in important ways, and the final national polling undercounted Trump's support by roughly 1-2 points. Maybe there is another systematic undercounting of Trump's support in the polling this year, and maybe late-breaking events move voters towards him, and maybe a large share of voters who disapprove of Trump's job performance can be persuaded to vote against Biden — but that is a lot of maybes.It is just as likely that Biden will outperform his already big lead. Elections tend to be referendums on incumbents, which is particularly true this year. Trump's polling numbers in head-to-head matchups with Biden have closely mirrored his overall job approval numbers. At the same time, Trump's job approval has been stuck in the low 40s effectively his entire time in office. Almost unique among modern presidents, he has never appealed to the majority of the country and has basically never tried. There really is no precedent for a chronically unpopular president who never tried to reach out beyond his base.If the final election results follow this job approval pattern, Biden wins in a landslide even larger than his current polling lead. Where Law Ends review: why Mueller failed to hold Trump to account Andrew Weissmann, a senior member of the special counsel’s team, has written an alarming and necessary bookThe Mueller investigation ended a year and a half ago, but the aftershocks never stopped. A passel of books highlight the omissions and missteps of the special counsel’s office. The Senate intelligence committee report fills in some of the gaps on Russian interference in the 2016 election.Although Robert Mueller found no basis for conspiracy charges, collusion remains a partisan buzzword, obstruction of justice a live concern. The harshest criticism leveled at Mueller is that he blinked.Specifically, the special counsel failed to issue a grand jury subpoena to Donald Trump, needlessly ceding the advantage to the White House. Then, his report went silent on whether grounds existed for charging the president with obstruction of justice, despite analysis that revealed such grounds. The weight of the presidency and fear of its occupant triumphed.“Had we used all available tools to uncover the truth, undeterred by the onslaught of the president’s unique powers to undermine our efforts?” asks Andrew Weissmann. “I know the hard answer to that simple question: we could have done more.”That makes Where Law Ends unique among Trump-themed books. The author was a member of Mueller’s team, supervisor of the prosecution of Paul Manafort. He is both admiring and critical of his former boss, which lends credibility and originality. Pathos is part of the package too.Weissman is a former federal prosecutor whose career intersected with Mueller’s, FBI general counsel when Mueller was director. Before the FBI, Weissmann had a reputation for zealousness. In the Enron case, he successfully prosecuted Arthur Andersen, only to see the supreme court overturn the conviction and to watch the accounting firm close.As a younger government lawyer, Weissmann prosecuted Felix Sater. In 2015, according to the Mueller Report, Sater explored the “possibility of a Trump Tower project in Moscow while working with the Trump Organization”.Under an apt subtitle, “Inside the Mueller Investigation”, Weissmann offers a detailed look at why the special counsel reached the conclusions he did, and expands on how Bill Barr ambushed Mueller with his four-page summary of a 400-plus-page report.“We had just been played by the attorney general,” Weissmann writes.Weissman expresses anger toward Barr but points the finger at Mueller: “Part of the reason the president and his enablers were able to spin the report was that we had left the playing field open for them to do so.”He is convinced of the substantive basis of an obstruction claim, even if justice department guidelines precluded the indictment of a sitting president. The “facts of the [James] Comey firing appeared to satisfy all the elements of … obstruction of justice”, Weissmann writes. “There was simply no other credible conclusion one could reach.”Where Law Ends also worries about the future of the US body politic.“I now know that the death of our democracy is possible,” Weissmann writes. “Fixing it is possible too.”That is the book’s last line. Weissmann’s rhetoric is hot – but not overblown.Trump has publicly refused to commit to a peaceful transition of power. Take him literally and seriously, especially when polls show Biden up in Ohio, with Iowa and Georgia close.“We’re going to have to see what happens, you know that” is one for the ages. Whether it is a historic blip or a harbinger remains to be determined.Where Law Ends is also a guide to how the Mueller investigation divvied up its work. Sections on the case of Michael Cohen are particularly instructive. Trump’s fixer was charged by federal prosecutors in the Southern District of New York – a strategic decision.Weissmann explains that the investigation of potential campaign finance violations fell outside Mueller’s purview. He could have sought permission to charge Cohen from Rod Rosenstein, then deputy attorney general. Or he could hand the case to SDNY, where in Weissmann’s words, “prosecutors have free rein to examine all potential federal crimes”.Contrary to the hype surrounding the early days of the Mueller investigation, this was no “dream team”. In Weissmann’s telling, senior members did not possess supervisory experience, and in one instance a lawyer was hired simply because he had been a supreme court clerk. Those looking to work for Mueller were prone to both cockiness and hand-wringing, traits Mueller himself found distasteful.At one point, Mueller turned to Jeannie Rhee, a veteran prosecutor, and said she embodied the “pizazz” he wanted, but which appeared lacking in the applicant pool. Rhee, Weissmann writes, possessed “a kind of can-do, combustible energy” which is always in high demand and short supply.Weissmann upbraids Aaron Zebley, another Mueller deputy, for being overly cautious. Weissmann and Rhee concluded that the broad issue of Russian election interference was within their purview. For Zebley, the focus was limited to possible “links and coordination” between Russia and the Trump campaign.Weissmann hearkens back to the generals who served Abraham Lincoln, comparing Zebley to the “timorous” George McClellan, reluctant to fight the Confederates, and presenting himself and Rhee as approximations of Philip Sheridan and Ulysses S Grant. Sheridan helped defeat Robert E Lee at Appomattox Courthouse. Grant, who accepted Lee’s surrender, would be elected president.Perhaps Weissmann overstates. William Barnett, the FBI agent assigned to the case, contends that the lawyers, not his bureau’s investigators, drove most of the decisions. In a recent filing by the government in the Michael Flynn case, Barnett also says the special counsel’s office was both permeated by groupthink and out to “get” the president. Either way, Where Law Ends is a dispiriting work. It is not simply about the Mueller investigation, or Trump. It is also an examination of where America stands.Weissmann contrasts Trump’s inauguration with protest marches held the day after, and observes the country’s changing demographics. Mindful of history, he ponders whether the civil war ever ended. Looking at the coming election, that is an open question. America’s fissures are once again on display. https://ift.tt/3n6vAvU

South Korea handed over the remains at a ceremony at Incheon airport outside Seoul, and a Chinese military transport plane flew them to Shenyang, a northeastern Chinese city near the North Korean border. Chinese soldiers fought on the North Korean side against US-led forces in the South during the war on the Korean Peninsula. Most of the 117 remains were found in the Demilitarized Zone that separates North and South Korea. It was the seventh annual repatriation, and the largest since the 437 returned in the first one in 2014. In all, the remains of 716 Chinese soldiers have been sent back. New York reports 1,000 coronavirus cases for first time in months For the first time since June 5, New York state, the home of the United States' worst coronavirus outbreak since the pandemic began earlier this year, reported just over 1,000 new COVID-19 cases in a 24-hour period.Gov. Andrew Cuomo (D) announced Saturday that the Empire State crossed the quadruple-digit threshold, though he didn't specifically address the number, saying only that New Yorkers should continue to practice social distancing, wear masks, and follow other mitigation guidelines.The state has seen a consistently upward trend in cases over the last week, which has prompted some concern as businesses and college campuses reopen, and officials have noted that spikes in some neighborhoods in the New York City boroughs of Brooklyn and Queens are especially worrisome. But New York also continues to see a high number of daily tests. Data collected by the state shows the positivity rate has remained at 1 percent, or just a tick below, for some time now, indicating that the high volume of tests is a significant factor in the case increase.A new study published by The Lancet on Friday that searched for COVID-19 prevalence in a large nationwide sample of patients on dialysis found that about one-third of those tested in New York showed signs of a previous coronavirus infection. In terms of the study, that's the highest of any state in the U.S. and while it's far from what experts have pinpointed as the target for herd immunity, those experts have also pointed out that numbers like that can still help slow the spread of the virus. Suspect in Shooting of Two Louisville Police Officers Identified The suspect accused of shooting two Louisville, Ky. police officers during protests Wednesday night has been identified by the Louisville Metro Police Department.Larynzo Johnson, 26, was arrested Wednesday and has been charged with assault of a police officer and wanton endangerment. He will be arraigned on Friday.Johnson “intentionally used a handgun to fire multiple bullets at officers” who were at the scene of protests downtown that erupted in response to the state attorney general's decision to charge only one of the police officers who fatally shot Breonna Taylor. Police said witnesses observed Johnson firing at officers before fleeing the scene, and video of the incident obtained by law enforcement showed him shooting a handgun in the direction of police. Johnson was also in possession of a handgun when he was arrested, the complaint filed in Jefferson County said.Two Louisville police officers were shot and sustained serious injuries. One of the officers was in surgery Wednesday night.Earlier on Wednesday, Kentucky Attorney General Daniel Cameron's office announced first-degree wanton endangerment charges against one of the officers who shot into the house where Taylor, a black 26-year-old emergency medical worker, was killed on March 13. The officer was not charged with murder, and the other two officers involved in the fatal shooting were not charged.Taylor was shot eight times in her apartment as Louisville police officers executed a search warrant for two men who were known to reside there. The officers who shot her were not charged. The warrant was issued because police suspected that a man connected to a drug ring was receiving packages containing drugs at Taylor’s apartment, but no drugs were found in the raid.Protesters “set fires, caused property damage and failed to disperse after being warned,” according to the complaint. Demonstrators also looted several businesses and climbed on top of city vehicles, police said. Nearly 100 protesters were arrested during the protests.Louisville Mayor Greg Fischer declared a state of emergency on Tuesday “due to the potential for civil unrest” as the city braced for the grand jury decision on charges against the officers.
